Mediation
Mediation offers full flexibility concerning procedure but any proposed settlement reached at mediation is not binding on the parties until finalised subsequently.
Mediation is a very effective way of narrowing the gap between the parties' positions and often leads to a successful resolution. Mediation is helpful for resolving matters where the parties wish to continue to work together.
As mediators we bring a combination of commercial, technical and facilitation expertise to help each party understand the strengths and weaknesses of its position so that both parties may identify a mutually-acceptable resolution.
Charteris recently helped a large systems integrator and a government body to resolve a multimillion pound dispute concerning a system implementation. As mediators, we were able to help each party to estimate the risks and costs of escalating the dispute to litigation and hence to identify a settlement package that provided a farourable means of ending the dispute for both parties. The parties were then able to work together again.
